Purchase of newly built homes


Buying a newly built home is different from buying a resale home. A resale home can be inspected before closing as it is a finished product, but a new home is purchased before its completion and before its construction is commenced. Thus, it is extremely important to have the Agreement of Purchase and Sale reviewed by a Real Estate lawyer. Two new legislations, the New Home Construction Licensing Act, 2017 and the Protection for Owners and Purchasers of New Homes Act, 2017, brought many protective measures to the governing law of newly built homes in Ontario. The Tarion Warranty Corporation administers and enforces the Ontario New Home Warranties Plan Act and Regulations. Purchase of new & resale condominium units


Condominiums are the ownership acquired by a purchaser of a unit in a row of townhouses, or an apartment in a multi-storey building, shared with owners of a project as tenants in common of all the common elements of the project. The purchaser will also become a member of the condominium corporation that administers the condominium property. While the steps and procedures for the transaction of a purchase of a condominium resale unit are similar to a residential purchase of property owned in fee simple, there are a few differences.


The Title Search, Execution Search, obtaining a Status Certificate, etc. differ in some respects from the usual residential purchase of property in fee simple. The Purchase of new condominium units is governed by new legislation as described before.
